Consumer Case # 1504/04: Ankur Raheja V SIFY Limited & Others
(Reducing the promised broadband speed is deficiency in service)

In the aforesaid matter, North-West Delhi Consumer Redressal Forum has ordered Nasdaq listed SIFY Listed to pay compensation to a consumer for indulging in Unfair Trade Practies and Deficiency in Services. The case related to non-disclosure of singnificant terms and conditions, and wrongly branding of packages as 'Unlimited', when there existed limitations as to data. Hon'ble Court for the first time interpreted the matter from the point of view of definition of BroadBand as laid down by TRAI and accordingly assumed the promised speed as 256 Kbps.

TRAI defines BroadBand as "An always-on data connection that is able to support various interactive services, and has the capability of a minimum download speed of 256 Kbps”. Hon'ble Court observed that promising to provide a connection having a minimum speed of 256 Kbps, and then reducing the speed after the customer downloaded 750 MB of data per month to 14 Kbps, "cannot be said providing proper services in any manner". Moreover, concealing the hidden conditions and not redressing the grievances of the complainant, who made several complaints, "amounts to deficiency in service".
