India-US sign MOU on deal with cyber crime

India and US have entered into a Memorandum of Understanding (MOU) to fight cyber crime jointly by timely exchange of information between the Computer Emergencies Team of both Countries, namely Indian Computer Emergency Response Team (CERT-In) and the US Computer Emergency Readiness Team (US-CERT). The agreement was signed by Jane Holl Lute, Deputy Secretary for the US Department of Homeland Security ( DHS) and India Department of Information Technology Secretary R Chandrashekhar in July 2011.

The MoU will establish the best practices for exchange of critical cyber security information and expertise between the two governments through the respective agencies. The MoU helps fulfill the commitment of both nations to advancing the global security and countering terrorism, one of the pillars of the US-India Strategic Dialogue, launched in July 2009.

CBI Website hacked by Pakistan Hackers

Pakistan Hackers (called “Pakistani Cyber Army”) hacked CBI website on Friday night warning Indian counterparts “Indian Cyber Army”, not to attack their websites.  The case under various provisions of Information Technology Act has been registered but the website that is available at: http://cbi.nic.in was a PHP website, which hasn’t been restored yet, even on the third day.

Dept. of Telecommunication proposes hi-tech snooping

India is finally poised to get a centralized surveillance and interception system across all communication platforms to effectively address national security concerns. The department of telecommunications has now prepared a detailed proposal for such a facility for the Cabinet Committee on Economic Affairs.

This is the government’s delayed response to the nation’s urgent requirement for hi-tech surveillance and technological interventions after the 26/11 attacks on Mumbai in 2008. According to the note, dated October 28, the proposed facility is estimated to cost Rs 540 crore, of which Rs 450 crore will come through government funding.

India to develop own Operating System: DRDO

Defence Research and Development Organisation (DRDO) in partnership with software companies in various metros and also few academic institutions have setup  a software development centre in Delhi and Bangalore. The main objective is to develop own Operating System starting next year, whose source code can be protected from various security threats.

Saraswat (Director General of DRDO and Secretary, Defence R & D) also said the DRDO has put in place a “complete framework” on the proposed commercial arm, which is currently in the process of securing necessary government approvals and is expected to be operational next year. He said this arm would customise and provide to the civil population the spin-offs of defence technologies through select industry partners, which would be production agencies.

Ministry of Corporate Affairs introduces e-stamping

MCA notification

All stakeholders are hereby informed that the provisions regarding stamp duty payment on Form No. 1, Memorandum of Association, Articles of Association, Form No. 5 and Form No. 44 electronically, at the time of their e-filing through MCA portal (www.mca.gov.in) in respect of the States and Union Territories mentioned below, shall be mandatory with effect from 01st April 2010. Please refer Notifications Number GSR 642(E) and SO 2276(E) dated 07-09-2009 and SO 3314(E) dated 31-12-2009 issued by the Ministry.

List of States and Union Territories:

Andaman and Nicobar Islands, Andhra Pradesh, Arunachal Pradesh, Assam, Bihar, Chhattisgarh, Delhi, Gujarat, Haryana, Jharkhand, Karnataka, Kerala, Lakshadweep, Madhya Pradesh, Maharashtra, Manipur, Meghalaya, Orissa, Punjab, Rajasthan, Tamil Nadu, Uttar Pradesh, Uttarakhand and West Bengal.

In the Companies (Electronic Filing and Authentication of Documents) Rules, 2006, in rule 3, in sub-rule (1), after the proviso, the following proviso shall be inserted, namely :-

“ Provided further that if stamp duty on such documents is paid electronically through Ministry of Corporate Affairs portal www.mca.gov.in, in such case, the company shall not be required to make physical submissition of such documents, in addition to their submission in the electronic form:

Provided also that in respect of certain documents filed under the Companies Act, 1956 which are not covered for payment of stamp duty through Ministry of Corporate Affairs portal, and stamp duty payable on such documents in respective state is equal to or less than one hundred rupees, the company shall scan such stamped documents
complete in all respects and shall file electronically for evidencing by the Registrar and shall not be required to submit such documents, except those which are required to be filed for compounding of offences under clasue (a) of sub-section (4) of section 621A of the Companies Act, 1956, in the physical form separately:

Provided also that the company shall retain such documents duly stamped in original for a minimum period of three years from the date of filing of such documents and shall be required to produce the same as and when the same is required for inspection and verification by the competent authority being the Collector of Stamps of respective State or Union territory or the Registrar”.

Delhi High Court gets the first E-court in India

Delhi High Court Justice Shri S Ravindra Bhat now has a court embedded with the latest of Technology. The gadgets like LCD and touch-screen notebooks replaced the bulky files with an assurance of speedy justice for all. The E-court was launched on 15 December 2009 and with the 33 matters listed, went on smoothly. The court has already digitalized approx 5.5 crore papers pertaining to various cases upto 2007. And more is expected to be digitalized soon…

The Technology involved use of Digital Signatures by Judges, Touch Screen for making corrections, USB Devices for carrying data into the court and soon to be implemented – Video-conferencing for witnesses, Summons & various others Documents through emails, SMS alerts, E-stamps instead of stamp paper, Webcasts of Court proceedings, etc.

After the successful launch and testing of the E-court system in High Court, it would soon be implemented in various district courts.
